ECAC - Forum - Registration



By accessing "https://actris-ecac.eu/forum.php", a contract with the following provisions is concluded between you and the operator:



1. USER AGREEMENT
a. By accessing "https://actris-ecac.eu/forum.php" (hereinafter referred to as "the board") you enter into a user agreement with the operator of the board (hereinafter referred to as the "operator") and agree to the following terms.
b. If you do not agree with these regulations, you may not continue to use the board. For the use of the board the regulations published at this place are valid in each case.
c. The user agreement is concluded for an indefinite period of time and may be terminated by either party at any time without notice.

2. GRANTING OF RIGHTS OF USE
a. With the creation of a contribution you grant the operator a simple, temporally and spatially unrestricted and free right to use your contribution within the framework of the board.
b. The right of use according to point 2, subpoint a remains in force even after termination of the user contract.

3. DUTIES OF THE USER
a. By creating a contribution, you declare that it does not contain any content that violates applicable law or morality. In particular, you declare that you have the right to set or use the links and images used in your contributions.
b. The operator of the board exercises the domiciliary right. In case of violations of these terms of use or other rules published on the board, the operator can exclude you temporarily or permanently from the use of this board and ban you from the board.
c. You acknowledge that the operator is not responsible for the content of posts that he has not created himself or that he has not taken note of. You allow the operator to delete or block your user account, posts and functions at any time.
d. You also allow the operator to change your contributions, if they violate the above rules or are likely to cause damage to the operator or a third party.

4. GENERAL PUBLIC LICENSE
a. You acknowledge that phpBB is forum software provided under the "GNU General Public License v2" (GPL) by phpBB Limited (www.phpbb.com); German language information is provided by the German speaking community at www.phpbb.de. Neither of them have any control over the way the software is used. In particular, they cannot prohibit the use of the software for certain purposes or influence the content of third-party forums.

5. RESERVATION OF RIGHT TO MAKE CHANGES
a. The Operator is entitled to change the Terms of Use and the Privacy Policy. The change will be communicated to the User by e-mail.
b. The User is entitled to object to the changes. In case of objection, the contractual relationship existing between the Operator and the User shall expire with immediate effect.
c. The changes are considered accepted and binding if the User has agreed to the changes.

ECAC provides a platform for exchange. In doing so, ECAC creates the framework for registered users to create contributions, questions and messages and to exchange information with each other. The legal responsibility for the respective contributions is borne by the creating users. A reading access to the contributions is available to everyone without registration - with few exceptions in individual forums. However, registration is necessary for the creation of posts and for the use of other functions of the board, in the context of which we collect and process personal data. Furthermore, we collect certain information even in the case of anonymous access in order to offer the functions available on ECAC-Forum and to be able to exclude or track illegal use of the offer. In the following, we inform you about the collected data and how we handle them. Furthermore, we will provide you with further information about the operator and your rights.

3. PERSONAL DATA DURING REGISTRATION
During registration we collect your e-mail address. Furthermore, you have to choose a user name (pseudonym), which forms a bracket over all your contributions. While your username is visible to everyone, only we as the operator of ECAC-Forum have access to your e-mail address. In addition, you can enter further data in your profile, such as your name, institute, ECAC unit and other contact details. Above that you can define a signature (free text), which - depending on what you enter - may contain personal information. This information is voluntary, so you can decide for yourself which information you want to enter and publish. The data you enter is freely accessible on the Internet in the context of your contributions. We also record the IP address and the time stamp as proof of registration and agreement to the terms of use including these notes on the processing of personal data. By collecting the data during registration or in your profile, you consent to us processing this data and publishing it as described above (Article 6(1)(a) DSGVO). Your email address as well as the collected IP addresses and timestamps are also necessary to fulfill the user contract (Article 6(1)(b) DSGVO). You can revoke your consent at any time or change the data you have entered in your profile at any time.

4. PERSONAL DATA DURING USE
When using ECAC-Forum, personal data is collected at various points:
- When using the contact form, unless you are logged in, your name and email address are collected and stored.
- When creating and deleting posts (this includes private messages and participation in surveys), the IP address from which the post was created or deleted is stored for documentation purposes and to prevent misuse.
- If you change any key information in your user profile (email address, account activation, user password) or if you fail to log in, your IP address will also be stored for record keeping purposes and to prevent abuse.
- When visiting phpBB.de, log files about the use of the server are collected, which also include the IP address of the access.
The collection of data in the contact form is done to enable contact and to archive correspondence that takes place in the context of the operation of ECAC Forum. It is carried out pursuant to Article 6(1)(b) (performance of contract), (c) (legal obligation) and (f) (legitimate interests of the controller) DSGVO. The other data is stored according to Article 6 paragraph 1 letter f DSGVO in order to prevent misuse of the services offered on ECAC-Forum and at the same time to give third parties the possibility to take action against possible legal violations.
Note: According to Art. 21 DSGVO, you have the right to object to the data storage, provided that it is based on Article 6(1)(f) DSGVO and there are reasons arising from your particular situation. As a precaution, we point out that the collection of this data is necessary for the assertion, exercise or defense of legal claims.

5. KEEPING OF BLOCKING LISTS
We reserve the right to keep blocking lists of e-mail addresses, domains or IP addresses if the corresponding address has been used as a basis for misuse of ECAC-Forum or if a house ban has been issued. The basis of the storage is also here Article 6 paragraph 1 letter f DSGVO. As a precautionary measure, we would like to point out that, especially in the case of the blocking of domains or IP addresses, it is usually impossible or only possible with a disproportionate effort to inform the data subjects (Article 14(5)(b) DSGVO).

6. USE OF COOKIES
When you visit ECAC-Forum, various cookies are created to ensure that you have a consistent user experience across all pages of ECAC-Forum. Specifically, the following cookies may be created:
- A cookie (ending in _sid) stores a unique, random ID. This forms a bracket over all page views and ensures that your settings, etc. are retained when a new page is called.
- Another cookie (ends with _u) stores - if you are logged in - your internal user ID. If you are not logged in, the ID of the guest user (usually 1) is stored here.
- A cookie (ends with _k) stores a key that is used for the automatic login, if you have activated this function.
- A cookie (ends in _track) can be used to store which forums, topics and posts you have already read.
- Under certain circumstances, a cookie (ending in _lang) may be created to store a language preference you have chosen.
- If you have voted without logging in, another cookie (includes _poll_) is created to store your vote and ensure that you do not vote more than once.
These cookies are stored by your browser for a maximum of one year and are sent to us each time you visit the site. You can delete them at any time by using the "Delete all board cookies" function offered in the forum or by using a comparable function of your browser.

7. PURPOSE OF PROCESSING PERSONAL DATA AND ITS LEGAL BASIS:
The personal data when registering on ECAC-Forum are stored and processed to fulfill the concluded user contract and with your consent (Article 6(1)(a) and (b) DSGVO). The personal data when using ECAC-Forum as well as the blocking lists are stored in order to prevent misuse of the services offered on ECAC-Forum and at the same time to give third parties the possibility to take action against possible violations of the law (Article 6(1)(f) DSGVO). The data transmitted via the contact form, are stored to enable contact and to archive the correspondence that takes place in the context of the operation of ECAC-Forum (Article 6(1)(b), (c) and (f) DSGVO).

8. DISCLOSURE OF DATA
The data not intended for public provision will not be disclosed by ECAC-Forum to third parties. This does not include disclosure to law enforcement or judicial bodies, for the pursuit of legitimate legal interests or on the basis of legal obligations.

9. DURATION OF STORAGE
The data collected during registration will be stored until the end of the user contract. After a revocation, we will store the central data of your profile (e-mail address, user name as well as recorded IP addresses and time stamp (see above)) for a maximum of 13 months in order to fulfill verification obligations and to prevent misuse of the forum. The IP addresses recorded during the creation of a post (incl. private messages and participation in surveys) as well as during central changes to the user profile will be deleted after 13 months at the latest. The failed login attempts and the personal data (IP addresses) stored in the log files of the server will be deleted after 4 months at the latest.

10. RIGHT TO INFORMATION
You have the right to obtain information about whether personal data about you is being processed. If this is the case, you also have the right to obtain information about this data and further information according to Art. 15 DSGVO. For a request for information, please contact the responsible person (see above) or use the contact form.

11. RIGHT TO REVOKE CONSENT.
You have the right to revoke your consent to the storage and processing of your data at any time. In this case, we will terminate the user agreement.

12. REQUIREMENT FOR THE PROVISION OF DATA
For the registration on ECAC-Forum and the use of the functions, which are available only to registered users (esp. the creation of posts, the use of private messages and other functions of the forum software) the specification of an e-mail address is required. Registration is not possible without this information.

13. AUTOMATED DECISION MAKING
No automated decision making takes place.

You agree not to post any abusive, obscene, vulgar, slanderous, hateful, threatening, sexually-orientated or any other material that may violate any laws be it of your country, the country where “ECAC - Forum” is hosted or International Law. Doing so may lead to you being immediately and permanently banned, with notification of your Internet Service Provider if deemed required by us. The IP address of all posts are recorded to aid in enforcing these conditions. You agree that “ECAC - Forum” have the right to remove, edit, move or close any topic at any time should we see fit. As a user you agree to any information you have entered to being stored in a database. While this information will not be disclosed to any third party without your consent, neither “ECAC - Forum” nor phpBB shall be held responsible for any hacking attempt that may lead to the data being compromised.
